Download Booking Form For the purposes of this contract "the Company" shall mean JD Windborne Travel Ltd having its registered office at 17 Bedford Street, Barrowford, Nelson, Lancashire, BB9 6DA.
All bookings are subject to these Booking Conditions and will form the basis of your contract with the Company. Please take time to read these terms as they set out both The Company and your rights and obligations under this contract.
A legal binding contract between The Company shall come into full force and effect at the date of the booking confirmation sent to you by us in accordance with these terms.
Some of the services provided to you will be subject to Supplier terms and conditions, these conditions are available upon request.
Booking Confirmation and details and medical conditions
Your booking will be confirmed (subject to availability) by return of an ATOL receipt which will be sent by fax, e-mail post or other appropriate means. Upon receipt you must check that all information contained withinthe confirmation is correct and complete, in the event that any information is incorrect or missing you must contact us immediately, and certainly no later than 7 days after the date of the confirmation, or 14 days prior
to the date of travel whichever is the earlier. The Company cannot accept liability for any losses occurring as a result of your failure to notify us of any inaccuracies in the booking confirmation, tickets or any other
document in accordance with these terms. We endeavour to ensure that all information and prices contained within our brochures and other publications are correct at the time of publishing, however changes,
omissions and errors do occur from time to time and it is your responsibility to ensure that all details contained within your booking are correct at the time of booking.
If you or any other person named on this booking have any special needs, requests or medical problems these must be requested at the time of booking, the Company is not responsible and accepts no liability to
provide for any special needs or requests over and above it's statutory or common law obligations, and cannot be responsible if any special requests or needs are not notified at the time of the booking. If in the
opinion of the Company we cannot provide for your special needs or medical problems on the grounds of health and safety we reserve the right to decline your booking.
Booking Consents
The person making the booking must be over the age of 18 and must be authorised to make the booking on behalf of all persons named in this booking. In the case of any named persons being under the age of 18,
consent must have been given by their parent or guardian.
Payment & Prices
The person making the booking is responsible for making the payments for all persons named in this booking. Payment must be made by cheque, bank transfer, postal order or cash. At the time of booking a deposit
of £90 will be required along with the insurance premium. Payment will be required in full no later than 8 weeks prior to the departure date, in the case of bookings made less than 8 week prior to the departure date,
full payment will be require at the time of booking. In the event that you wish to cancel the booking prior to the date of departure the cancellation fees contained within these terms will apply. The cost of your holiday
includes all VAT and appropriate local taxes.
It is our policy to calculate holiday costs at prices which include any increase planned by hoteliers, transport companies or other suppliers known at the time. The costing date for each holiday is shown on your confirmation of booking. However, if holiday costs do increase after this date due to government action, fuel or currency fluctuation, the extra amount will be passed on in the form of a surcharge, not less than 30 days before departure. We guarantee any extra amount advised at this time will be the final amount to be paid by you and any further increases will be borne entirely by us. In exchange for this financial risk, no refund will be made in respect of change in holiday costs or exchange rates, which are favourable to us. We guarantee to absorb any amount equivalent to 2% of the holiday price (excluding any amendment charges and insurance premiums). Only amounts in excess of 2% will be surcharged.
Insurance
You must have adequate travel insurance in place before you travel, it is a condition of this contract that full details of travel insurance for each person travelling is disclosed to the Company prior to departure It isessential that all premiums are paid prior to departure as it may invalidate your cover if premiums have not been paid. Insurance cover will be offered by the Company for the appropriate premium at the time ofbooking.
Liabilities
The Company will use reasonable skill and care to carry out its contractual obligations contained within this booking. The Company will be liable in the event of death, personal injury, or failure to meet its contractual obligations to the extent that such death, injury or failure to meet contractual obligations is caused by the Company or an employee acting on behalf of the Company.
The Company will not be liable in the event of death, personal injury, or any other loss, expense, cost or damages to the extent that such loss, expense, cost or damages are caused by any person named on this booking, or by any third party.
The Company will not be liable to pay compensation where its performance of contractual events is wholly or partially prevented or is delayed by a force majeure event. For the purposes of this clause a force majeure event shall be an unforeseeable and unavoidable event which shall include but not be limited to riot, war, invasion, act of foreign enemies, hostilities (whether war be declared or not), acts of terrorism, civil war, rebellion, revolution, insurrection of military or usurped power, Ionising radiation’s or contamination by radio-activity from any nuclear fuel, Pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speeds, Earthquake, flood, fire, explosion and/or other natural physical disaster, strikes, industrial disputes or lockouts, maritime or aviation disasters, changes to any general or local statute, ordinance, decree, or other law, or any regulation or bye-law of any local or other duly constituted authority or the introduction of any such statute, ordinance, decree, law, regulation or bye-law.
You will be liable for any losses or damage caused by any person named on this booking and agree to indemnify The Company from all losses, expenses including damages and legal expenses levied against The
Company as a result of damage caused by you or any other person named on this booking to the premises or property of accommodation owners or any other The Company suppliers.
Cancellation
If any person named on the booking form wishes to cancel the booking notice must be given to The Company in writing. Notices of cancellation shall become effective upon receipt by The Company and all cancellation charges will be calculated from the date of receipt.
The cancellation charges shown below are based upon the percentage of the price payable by the person cancelling excluding insurance premiums and variation prices which are non-refundable. The price of the
booking will also be subject to increase due to any under occupancy resulting from the cancellation or due to discounts, free places or other oncessions granted at the time of booking which no longer apply due to the
cancellation. Cancellation charges will be as follows:
If in our reasonable opinion or the reasonable opinion of any other third party any person named on this booking acts in a manner likely to cause injury, death or distress to other guests or third parties, or likely to cause
damage to the property or premises of others The Company shall have the right but not the obligation and without prior notice to terminate your booking without compensation or refund and all our obligations and
liabilities to any person named on this booking shall immediately end.
Variations
Any amendments that you require to your booking must be confirmed to The Company in writing. We will make every effort to make the required amendments but cannot guarantee that they will be accepted. All
changes will incur a fee of £20 per amendment as well as any charges that The Company incurs from subcontractors or other parties in making the changes.
In the event that The Company needs to make major changes prior to departure we will inform you as soon as possible. Major changes are changes to the area of accommodation or the standard of accommodation to a
lower officially rated accommodation but do not include changes to airline or flight times. If the time of departure allows and subject to availability the following options will be offered:
Changing to an alternative holiday booked with us and of a similar standard to the original booking subject to availability.
Cancellation of the holiday, for which a full refund will be provided.
Acceptance of the changes with no additional charge to you.
The liability to The Company for major changes and cancellations is limited to offering you the above mentioned options and, where applicable, compensation as detailed below. The Company cannot pay any expenses,
costs or losses incurred by you as a result of any change or cancellation. Where applicable compensation will be calculated as follows:

Legal jurisdiction
It is agreed that this contract is made in accordance with the laws of England and Wales and in the event of any dispute between us we both agree to submit to the exclusive jurisdiction of the English courts.
Complaints procedure
Any complaints must be confirmed in writing to The Company at 17, Bedford Street, Barrowford, Nelson, Lancashire, BB9 6DA, the Company cannot accept liability for any complaints not made in writing within 28 days
from the occurrence of the event giving rise to the claim, other than complaints in relation to death, illness or personal injury.
Passports, visas and other travel documentation
It is your responsibility to ensure that all persons named in this booking have full and valid passports and any applicable visas. If any member of your party is not a national of the EU then we advise that you check with
the relevant embassy as to what travel documentation is required.
Confidential Information Some of your and your parties' personal details including but not limited to details of disabilities, medical conditions, and religious beliefs may need to be collected by the Company in order to
process your booking.
Some of these personal details may need to be passed on to suppliers, and other organisations and individuals such as hotels and airlines in order to provide your holiday requirements.
Additionally the Company would like to use some of your personal details for marketing purposes and would like to pass this information onto certain selected third parties; this may include information by phone, post or
e-mail. If you don't want us to use your details for such purposes then please let us know and we will not use your details for marketing purposes. Unless you notify the Company to the contrary we are entitled toassume that you consent to your personal information being used for the aforementioned purposes, and unless otherwise allowed by the Data Protection Act and any amendments thereto the Company will only use
your personal data for the aforementioned purposes.
You are entitled at any time to write to us at the above to address and request details of what information we currently hold about you, an administration charge maybe applicable.
